UPDATE: David Tobias Injured in Flatbed Truck Accident in McGraw, New York


MCGRAW, NY — David Tobias was hurt in flatbed truck accident that happened in McGraw, New York on Monday, September 29th, 2014. The news report from WICZ said that the accident happened around 3:00 Monday afternoon.

24-year-old David Tobias was seriously hurt when a flatbed truck left the road and struck him on Main Street. The truck hopped a curb and hit Tobias, and 80-year-old Oneil Lang before hitting a parked water tanker truck. It is not clear what caused the vehicle to go off the road.

Tobias was taken to a nearby hospital. Lang has since died from his injuries.

The New York State Police are still investigating the accident.

Commentary:

 

There are plenty of reasons that this accident could have happened, but none of these are going to add up to a good excuse. Just glancing at the details in the news report raises even more questions about the accident. Creeping into a lane or hitting the bumps dividing lanes is one thing, but hopping a curb, driving on a sidewalk, and hitting a few pedestrians and a parked water tanker is indicative of a much bigger issue that needs to be addressed. Now, the driver probably didn’t maliciously drive onto the sidewalk with the intent to hurt people, but if this accident was caused by carelessness or inattention, doesn’t that mean the accident was preventable? It could be that the truck driver had a medical emergency, or some other issue that caused him to lose control, but it sure sounds like he just wasn’t paying attention to the road. Should this kind of driving or these kinds of mistakes go unpunished? What message would that send the trucking company or the trucking industry at large?

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
