Commentary
If this accident had happened at 2:0 in the morning, we’d feel pretty comfortable saying that the driver was most likely coming from a bar when the accident occurred. Statistically speaking, most drunk driving accidents happen as someone’s leaving a bar. Although it does happen, most people don’t get drunk at home and then go jump in their car and take a ride.
However, while these accidents tend to happen in the evening and late at night, it comes as no surprise that they can happen at anytime. We’re involved in an ongoing case in which a woman was picking up her child from daycare when she was hit and killed by a drunk driver who was driving home from Happy Hour at a Chili’s. So there are two possibilities here. The drunk driver was either coming from a bar or from his home. If he was coming from a bar, then the bar needs to be held responsible.
