Commentary
I know a lot of people think that all lawyers like myself hate truck drivers, and are taking every chance we get to talk about how they’re horrible at their job and that the world would be a better place if only we sued more of them. This is not the case. Let’s look at this driver. From what’s been reported, it seems as the accident was completely outside his control. He was just in the wrong place at the wrong time. Speaking from a legal standpoint, he would be able to file a liability claim against the driver, just like a driver would be able to against him, had the roles here been reversed. From what I’ve read, it doesn’t seem as if he was injured too badly. However, in addition to his physical injuries, I’d be willing to bet that there’s some emotional distress that’s also taken a toll, and also needs to be addressed.
