Benton, AR — A three-year old child had to be rushed to a local hospital after a piece of concrete came loose from a wall at the Capri Inn in Benton, Arkansas, and fell on his foot. The accident happened on Tuesday, September 23, 2014.
The child’s name is Brayden Bohac. Brayden’s mother, Tabitha, has said that he’s already had two surgeries performed on his foot, and has another scheduled for later this month. She says that her son has been in a lot of pain and that doctors currently have him on morphine.
Hasmukh Mehta, the owner of the hotel, has said, “We will fix it, that block, but he is responsible. We are not responsible. It’s an accident. I feel bad but I’m not at fault for that.”
Mehta has said that he’s filed an insurance claim and is not waiting for it to be processed.

What’s funny to me is that the owner of this hotel is talking about this accident as if no one could have foreseen it and that it was just completely unpreventable. I wasn’t there myself and I didn’t see it happen, but I’m just not buying it. If you own a store, or a restaurant, a hotel, it’s your responsibility to make sure that there aren’t any obvious dangers, like tools lying around, exposed wires, etc.
If a piece of this hotel’s facade broke off and fell on someone, there’s a good chance it was already cracked to begin with. If that’s the case, then the owner is either completely clueless about his own property, or he knew there were problems and didn’t care enough to do anything about them. Unfortunately for him, saying, “I’m not responsible,” doesn’t really absolve him of any legal responsibility.
