UPDATE: Ruth Berry Injured in Delivery Van Accident in Red Bank, New Jersey


RED BANK, NJ — One individual was seriously injured in a road accident involving a delivery van that was reported in Red Bank, New Jersey on Thursday, September 11th, 2014, according to the news article from the APP Online.

Accident investigation teams say that 85-year-old Ruth Berry was seriously injured she was struck by a delivery van when she was walking along or trying to cross the road on Newman Springs Road after leaving Burger King around 8:00 Thursday night. Berry was knocked unconscious in the accident.

The woman was flown by a helicopter to a nearby hospital where she remained in critical condition at Jersey Shore University Medical Center.

The investigation into the accident is being handled by officials from the New Jersey State Police.

The main fact that needs to be inspected in this accident is the location of the victim in the road when they were struck. Why is this important? Because contrary to popular belief, pedestrians do not always have the right of way, but witnesses describe the victim crossing the street when she was struck, and if she was in the crosswalk when she was struck, then the delivery van could be faulted for the accident. Furthermore, if the woman was not in a crosswalk at the time of the accident, but the van was turning, the van could still be faulted for failing to make sure the path was clear before making the maneuver.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
