RIVER COUNTY, TX — A single-vehicle accident into a residence sent a driver and a passenger to the hospital in Red Diver County, Texas on Tuesday, August 26th, 2014, according to the news release from KXII.
Police say that Michael Gresham was hurt when the vehicle he was a passenger in skidded off the road and collided with a nearby utility pole before crashing into the front of a private residence while driving on Clarksdale around 10:45 Tuesday evening.

Both Michael Gresham and the driver of the vehicle, identified as Lindsay Kelley were taken to a nearby hospital where they were being treated for unspecified injuries.
The investigation into the accident is being handled by officials from the Texas Department of Transportation.
Commentary:
With passengers in any kind of alcohol related accident, there are two potential avenues the liability could take, and in many cases, its a combination of both. Whenever a person enters a bar to consume alcohol, the bartenders and wait staff have a duty of care to cut a customer off when they either become visibly intoxicated, or if the server gets the suspicion that they are teetering on the .08 blood alcohol line. If the driver in this accident was consuming alcohol at a bar, and the bar failed in their legal obligation to refuse service when they should have, both the offending driver, and the bar responsible for fueling them can and should be held liable for the accident.
