Commentary
There are obviously a few questions that need to be answered before anyone’s able to chart a way forward here. I think we need to be realistic about what may have caused this accident. It’s possible the driver was using drugs at the time. Given the time of night, it’s also possible he was intoxicated. 2:30 in the morning, a lot of people are coming home from bars around that time. If the driver were at a bar and had been over-served, its possible that the bar could also be held liable. Don’t get me wrong. If the driver were drunk, that doesn’t change the fact that he made the decision to get behind the wheel. But if he were visibly intoxicated and the bar kept serving him, that would impair his ability to make rational decisions, meaning that the bar would have played a very real role in the accident that later killed him. If that turns out to be the case, then they should also be held responsible.
