Commentary:
Tractor-trailer accidents like this happen for one of two reasons generally. One one side of the coin, we have a situation where a driver could have been speeding. In all my history of investigating these kinds of accidents, I’ve never seen a tractor-trailer roll over that was driving at a speed that was safe for conditions. On the other hand, these trucks are often part of a larger fleet, and repairs can fall by the wayside for a multitude of reasons. If the air-brakes failed due to being in disrepair, the trucking company should be found liable, just like you would be if you allowed your car to fall apart and cause an accident.
