Commentary:
Any time I run a fact pattern like this by one of my friends, they always seem to have it in their minds that the driver of these vehicles is always at fault, but I’m quick to tell them that this is a horrible way to approach an accident investigation. Sure, there is a chance that the accident was related to driver error, but is this the only possibility? Absolutely not. If there are other avenues to investigate, shouldn’t they get equal attention? Mechanical problems cause accidents every single day on our roads, and inspecting the vehicle would tell us quite a bit. It could tell us that a steering lockup or brake failure is the real cause of the crash. Either way, these are the kinds of accidents that need a closer look.
