UPDATE: Margaret Moore Killed in Suspected Alcohol Related Accident in Tyler, Texas


TYLER, TX — A motorcycle passenger has died after a crash in Tyler, Texas on Saturday, July 5th, 2014, according to the report from KLTV.

Investigators believe Margaret Moore was killed when the motorcycle on which she was a passenger collided with the rear of another vehicle as they were both traveling the same direction on Paluxy Drive.

Margaret Moore was ejected from the motorcycle in the collision and was taken by EMS personnel to a nearby hospital where she died. The driver of the motorcycle was also seriously hurt in the collision.

The investigation into the crash is currently ongoing, and police are trying to determine if alcohol was a factor in the incident.

Commentary:

If alcohol did in fact cause this accident, it would be a good idea to find out where the driver was drinking before the accident. Why is this important? Because these are the kinds of questions that could unveil more parties liable for the accident. Texas is outfitted with liquor liability laws, otherwise known as dram shop laws, that ensure bars and restaurants sell and serve alcohol responsibly. If they failed in their duty to cut off an obviously intoxicated driver, kept serving them, and that driver causes an accident, the bar can and should be held liable right next to the driver. Think of how many drunk driving accidents could be prevented if we held bars to the same punishment standards drunk drivers are held to.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
