UPDATE: Gabriel Leyva Killed in Tractor-Trailer Accident in Lea County, New Mexico


LEA COUNTY, NM — A single-vehicle tractor-trailer accident left one driver dead in Lea County, New Mexico on Monday, June 30th, 2014, according to a news article released by News West 9.

Investigators have said that they have reason to believe 46-year-old Gabriel Leyva was killed when the tractor-trailer they were driving crashed and rolled for reasons currently under investigation while driving on Co Rd 2.

Gabriel Leyva was pronounced dead after the crash. It is not clear if they were killed instantly in the crash, or if he was taken by EMS personnel to a nearby hospital where he died a little while later.

The New Mexico State Police is currently investigating the accident.

Commentary:

It indicates in the news that the truck’s load could have shifted and caused this accident. If this turns out to be true, it could go a few ways. If there is another company that is responsible for the loading and securing of freight in the truck, and this company failed to properly tie down the cargo, the company could be in some part liable for the accident. On the other hand, if the truck’s cargo was properly tied down, and and the equipment used to secure the freight failed, the manufacturer of those failed parts could be liable, but nobody is going to be able to say conclusively until all the evidence can be combed over.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
