Richard Sterns Killed in Car Accident on Feeder Dam Road in Moreau, New York


Moreau, NY — A man was killed after the equipment trailer he was standing in was hit by a car in Moreau, New York, on Tuesday, June 24, 2014. The accident took place on Feeder Dam Road, around 9:45 in the morning.

The man has been identified as Richard Sterns. Sterns was part of a work crew taking shelter from a storm. The accident occurred when William Myott crashed into the trailer, killing Sterns. Police have cited Myott with reckless driving. Three other men in the trailer were injured.

Myott claimed he was trying to grab something from the dashboard of his car and missed the trailer.

Commentary

I don’t think that anyone is going to try and make the argument that the car isn’t at fault for the accident. It’s possible that the driver’s insurance company — now faced with a stack of medical bills — might look at things and say, “Well, the work crew shouldn’t have been inside the trailer.” But who expects that to hold up? The trailer belonged to them. They weren’t obstructing anything by being inside it. They had a right to be there.

And for some who may believe that this would be classified as a work-related injury, it wouldn’t be. The accident was caused by something outside the course and scope of the workers’ job descriptions: an intervening third party. So in this case it wouldn’t be the employer, but the driver who was responsible for the damage.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
