Commentary:
There is one major detail that sticks out like a sore thumb in this article, and that is the fact that the offending driver is under the legal age to drink. What significance does this hold? Well, around graduation season, many parents throw parties for their kids where alcohol is permitted or even provided by parents. If this driver came from one such house party, under ‘social host liability’ the hosts of the party could be liable for this accident. On the other hand, if this person purchased alcohol at a bar or liquor store without being carded, the business in question could also bear liability through what is called a third party dram shop claim, which asserts that the business failed to serve or sell alcohol in a safe manner, resulting in an accident.
