Commentary
Drivers owe a duty to their passengers to create a safe driving environment. In this case, the driver failed at that, and now a child is dead. Here, we have an underage girl who was drinking, so the question is, who’s at fault? Because this accident happened in California, the fault for the accident will fall squarely on the driver. The social host would not be held liable for serving alcohol. This isn’t the case in other parts of the country. In states like Texas, bars and similar establishments can be held liable for serving minors or persons who are obviously intoxicated. Because bars can play a very real role in accidents like this, so it’s important to hold them responsible for that. Because they’re playing just as big a role in the accident as the driver.
