Commentary:
In an accident like this, the State of Illinois has opted to use a pure form of comparative negligence, which is a tool used to mete out fault after an accident where at least one party has claimed injuries or property damage. A value of that damage is totaled, then a jury deliberates to what degree each person involved was at fault. Adding to this compiled evidence with your own independent investigation aids investigators in gleaning a closer approximation to what actually happened, and can sway the course of the investigation, and consequently the liability in cases just like this one.
