Commentary
Drinking and getting behind the wheel of a vehicle is always a bad idea. There’s no excuse for it. If the driver of the offending vehicle was drunk at the time of the accident, then they should be punished for it. It’s possible that the driver was drinking at a bar or similar establishment. If he or she were visibly intoxicated and the bar was still serving them, then they’d share some liability for the accident. This is a part of Colorado’s dram shop law. A lot of people believe that these laws blame the bar for the driver’s mistake. That couldn’t be further from the truth. These laws were set up to punish drunk drivers, as well as those who should have cut them off, but are still serving them alcohol. People forget that that’s a very real contributor to these sorts of accidents.
