Commentary:
In this article, it is suggested that the victims vehicle turned in front of the truck, which many people would blame the driver of the car for, when they really don’t have the information necessary to make that kind of judgment call. We’ve all made a turn across traffic that we felt was safe, with plenty of room, only to look in our rear-view once we clear traffic to see a speeding driver has missed you by mere feet. This happens because it is difficult to extrapolate the speed of a vehicle when it is heading in your general direction. If the truck was speeding, the electronic tracking data in the truck would reflect this, and it would have made it difficult for the victims to properly judge the turn. Most importantly, the trucking company could be liable for the accident if this is how things turn out.
