Commentary:
If you ever find yourself in an accident like this, you may be wondering what the procedure is for determining fault when an accident boils down to a he-said-she-said statement. In the State of Texas, as well as the majority of other states, we use a system of contributory negligence. How does this work? Well, in the event of an accident, a jury is supplied with all the evidence, and does their best to dole out fault as fairly as possible. This is where independent investigation comes in handy, because it adds to the pile of evidence and provides a more complete picture of the accident.
After a crash, police officers that take down the information are also responsible for tending to victims, reporting on their radio, clearing the road of wreckage, all while documenting the evidence. There is always a chance that something was missed, or something was documented incorrectly, taking a second look at the accident could shift liability to the proper places
