Commentary
Reports don’t shed any light on this, so I’m only speculating, but if the driver of the truck was drinking, it’s very possible the passengers were also. At least two of the passengers were underage, so of course they shouldn’t have been drinking, but there’s obviously no law against a passenger in a vehicle being intoxicated. So the driver of the vehicle has a responsibility to create a safe environment for those he’s traveling with. By getting behind the wheel while — allegedly — drunk, that’s not the driver of the truck was doing, and he would be held liable for injuries the others in the truck suffered. There is a possibility these kids were getting their alcohol from a bar or other establishment, and if that turns out to be the case, it’ll open up a whole can of worms one, for serving minors, and two, for shouldering some of the responsibility for the accident by serving the driver who caused it.
