UPDATE: Robert Sloan Killed in Suspected Alcohol Related Accident in Oakwood Hills, Illinois


OAKWOOD HILLS, IL — Two people died after a single-vehicle accident in Oakwood Hills, Illinois on Friday, May 2nd, 2014, according to a report from The Northwest Herald.

Police think that 22-year-old Robert Sloan was killed when the vehicle he was a passenger in crossed into the lanes of oncoming traffic and collided with a tree on the other side of the road while driving on West Rawson Bridge Road near Ida Drive at around 2:30 in the morning.

Robert Sloan was cut from the vehicle and was taken by EMS to nearby Good Shepherd Hospital where he died a short time later.

The driver of the vehicle was identified in the report as 25-year-old Bradley Kass, who was pronounced dead on the scene by emergency responders.

Authorities believe alcohol was a contributing factor in the accident.

Commentary:

If investigators discover that the driver had recently been at a bar there could be what we in the legal profession call a ‘3rd party dram shop claim’. Why does it matter if they were at a bar? Because some states are equipped with liquor liability laws that make a bar, nightclub, or liquor store culpable for an accident that their customer causes after they were over-served. If a customer becomes grossly intoxicated at a drinking establishment, the bar has over-served them, and could be held liable for any accident they cause if alcohol is found to be the cause of the crash.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
