One Injured in Motorcycle Accident on Ayers Road in Corpus Christi, Texas


CORPUS CHRISTI, TX — A motorcycle collision left one person in the hospital in Corpus Christi, Texas on Saturday, April 5th, 2014, according to a news article from KIII-TV.

Authorities have said that they have reason to believe one person was hurt when the motorcycle they were driving crashed into the rear of a vehicle while driving near the intersection of Ayers and Sunnybrook around 10:00 Saturday morning.

The driver of the motorcycle was taken by EMS personnel to a nearby hospital where an update on their condition was immediately unavailable.

Officials from the Texas Department of Transportation is assisting with the crash investigation.

Commentary:

Many people are genuinely confused as to how fault is determined in the State of Texas. Texas, as well as 32 other states use a system of ‘comparative fault’ or ‘contributory fault’ that essentially removes the guesswork from both victims and investigating police in establishing fault in an accident. Sometimes accidents, especially those that involve more than two vehicles, fault and liability can be a messy, muddled ordeal for all those involved. This is where contributory fault comes into play. Evidence is gathered by police before being presented to a jury, who then allocates fault on a percentage point scale to reflect fault as accurately and fairly as possible. This is where an independent investigation comes in handy, because police reports are often hastily written up, they can be inaccurate and often are discredited. Having the most complete information is tantamount in determining the truth behind any accident, which can often tip liability as well.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
