One Injured in Alleged Drunk Driving Accident on Harlowe Drive in Midland, Texas


MIDLAND, TX — One child was hurt in a single-vehicle rollover accident that happened in Midland, Texas on Wednesday, April 9th, 2014, according to a report from the Midland Reporter Times.

Authorities have said that they have reason to believe a child was hurt when the vehicle they were in crashed and rolled while driving on Harlowe Drive sometime Thursday night.

A child sustained unspecified injuries in the accident.

The investigation into the accident is being handled by officials from the Midland Police Department.

Commentary:

Many people are completely unaware of Texas’ unique liquor liability laws, and how they may relate to an accident like this one. Texas has a unique set of regulations that allow for 1st party claims against bars. What does this mean? It means that if a person is over-served alcohol at a bar before leaving the bar and hurting themselves in an accident, the bar can be held liable if they failed to serve alcohol responsibly. What does it mean when a bar over serves? Well bars are forbidden from both selling alcohol to an intoxicated person, or allowing somebody to become obviously intoxicated under their service. As you can imagine these regulations are violated quite often, and may warrant a second look at an accident that involves alcohol.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
