PROSPER, TX — One person was flown to the hospital after a major accident in Prosper, Texas on Tuesday, April 22nd, 2014, according to a news report from NBC DFW.
Officials have said that they believe one person was hurt when the vehicle they were driving collided with a van while driving on Highway 380 on Tuesday morning.

Authorities transported the driver of one of the vehicles in a helicopter where an update on their condition was immediately unavailable by hospital staff.
Investigators hope to release more information about the accident in the coming days.

Bearing in mind that the news report is very sparse on details, the fact remains that people may have some questions if ever they find themselves involved in a similar accident. In the State of Texas, we have a system that the majority of states use in allocating fault in an accident, and we in the legal industry call “contributory negligence” or “comparative fault”. With this system, a jury is presented with all the facts and evidence and to their best ability makes a judgment call and allocates responsibility for the accident using a sliding percentage scale. This means if Person A and Person B get in an accident whose damages total $10,000, and Person A is found to be 80% at fault for the accident, Person A would be responsible for $8,000, while Person B would owe $2,000. Keep in mind that the divisions of fault are RARELY this orderly, and I have simplified the system for the sake of explanation, but this is how this accident’s fault could be determined.
