Scene of the Accident

Jamarcus Myers was pronounced dead on the scene when they arrived. The driver of the other vehicle was identified as Michael Thompson, who sustained unspecified injuries in the accident.

The investigation is ongoing.

Commentary:

People involved in a two-vehicle accident may wonder how fault is decided, if police and the victims cannot reach a consensus. In the State of Texas, we have a system that is referred to in the legal industry as ‘comparative fault’, in which a jury is provided all the collected evidence before they do the best they can at assigning fault as fairly as possible. This is why the most thorough investigation possible is so important, and why independent investigations become so valuable. Police responders are often more concerned with clearing the accident and moving onto the next one, whereas independent investigators have no other accident to rush off to, and often these investigative professionals find much more than the initial investigation. For victims, the most important thing is finding the truth about the accident, as it should be.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
