Commentary:
People are often confused how fault is divided up with chain reaction accidents because they can be extremely confusing to investigators after the fact. Essentially, when one or more parties are involved in an accident where fault is difficult to nail down, a jury steps in and is presented with all the facts and evidence available to them. The jury then divides up the liability using a sliding percentage points scale that cuts the damages up as fairly as possible. This is why evidence collection and documentation is of the utmost importance, as the party with the more complete picture of events tends to be the victor. This is why I always recommend having an independent investigation conducted.
