Commentary:
A great many people I know would hear about a major accident in heavy snow conditions and call it unavoidable due to the weather, which couldn’t be farther from the truth. Truck drivers are rigorously trained to drive in any number of adverse conditions. Drivers are to slow their speed and adjust following distances, and failure to take these actions is dangerous. There are any number of reasons why this accident could have happened, mechanical failure, driver inexperience or inattention, or mechanical failure, but all of these roads lead to the trucking company. If the driver is found to have been driving too fast for conditions, this must be proven in front of a jury, and unfortunately the burden of proof rests on the victims in situations like these.
