Joe Garcia, Crista Connor and Infant Child Seriously Hurt in Major Auto Crash in Lubbock, Texas
According to the Lubbock Avalanche-Journal, four people were injured in
an auto accident involving a suspected drunk driver. The wreck occurred
around 11:30 p.m. Saturday, February 18 when 22-year-old Kyle Rodriguez
crossed into oncoming traffic and struck an SUV head-on. Troopers
believe Rodriguez was fleeing the scene of another accident. In the SUV,
Joe Garcia, Crista Connor, and their infant child were all injured. All
four were taken to University Medical Center with what are thought to
be non-life threatening injuries. Texas DPS officials reported bottles
of alcohol in and around Rodriguez's pickup.

Commentary Allegedly fleeing the scene of a previous accident and
potentially drinking and driving, I'm not sure which is worse.
Fortunately, both of these potential causes could play a role in a
liability assessment, and normative determinations will not be
necessary. If the reports are accurate, and the man swerved into
oncoming traffic, he could face serious fault in a personal injury
claim. Even with this allegation, and the prospective intoxication link,
it would be prudent to conduct a third party investigation into the
accident. This is because in any claim where a victim(s) seeks
restitution from an accident, they will be tasked with proving their
case. This means showing a jury that the driver's actions were contrary
to what a normal person may expect, and as such, breached their legal
duty on the roadway. If successful, a personal injury claim can aid in
areas like medical bills, pain and suffering, lost wages, etc.
