Transvaginal Mesh Claims Consolidated into Multidistrict Litigation
According to the Transfer Order published by the United States Judicial Panel on Multidistrict Litigation, transvaginal mesh claims have been consolidated within the Southern District of West Virginia. Claims against mesh makers American Medical Systems Inc., Boston Scientific Corp., and Ethicon, Inc. have been consolidated into the preexisting multidistrict litigation against Bard, also taking place within the Southern District of West Virginia.
Commentary
Within the products community, this was the next expected step related to the mesh claims process. It only makes sense to consolidate the claims against the various manufacturers into one venue for multidistrict litigation. As the order states, the judge presiding over the current motion against Bard is indeed the best suited to take on these other claims and hopefully the process will gain a bit of steam going into the spring.
