Commentary I hope
the 6 injured (believed to be high school aged) students fully recover
from the accident. If the reports are accurate and the sedan rear-ended
the bus, causing injuries to multiple people on board, they would each
have a claim against the driver of that vehicle. For this
claim to be applicable, victims would need to prove that a duty existed
on the roadway (typically safe operation of a motor vehicle) and that
this duty was breached by the defendant. There is no law that says an
insurance adjuster must pay out damages to a victim, so they will always
be tasked with providing evidence why they deserve to be compensated.
From there, a victim need only to produce an accurate account of damages
incurred, and of course the defendant must be solvent for a claim to
proceed.
