Two Motorcyclists Injured in Accident with Passenger Vehicle in Port Arthur, Texas
According to the Beaumont Enterprise, two motorcyclists were injured in
an accident involving a passenger car in Port Arthur, Texas. The wreck
occurred around 6:40 p.m. Saturday, February 11 when the two were
traveling along W. Port Arthur Road when a car turned into their path.
The riders tried to avoid the car but could not, striking the side of
the vehicle. Both motorcyclists were taken to Christus St. Elizabeth
Hospital, one in critical but stable condition.

Commentary My hope
is that both motorcyclists fully recover from the accident. In
attempting to seek compensation from the accident, it would be prudent
to conduct a separate investigation, in conjunction with the police
reports. This is because in any personal injury lawsuit, a plaintiff
(the victim) is tasked with proving why they deserve to be compensated.
It is not enough to have a police report with favorable details, other
variables must be met. The investigation is necessary
primarily for providing concrete liability to show a defendant. A victim
must first prove that another motorist owed them a standard of care at
the time of the accident (in this matter yielding right of way) and then
breached this standard with their actions. After liability, a victim
must then offer an accurate representation of damages incurred. This is
actually more tricky than it sounds, as providing this amount too soon
many not reflect the value of areas like rehabilitation or missed work.
On the other hand, waiting too long may allow an adjuster to scrutinize
the alleged injuries sustained from the accident and perhaps deflect
their cause to another event.
