Three People Hurt After Pedestrians Struck by Lamborghini in Houston, Texas
According to KHOU, three pedestrians were injured leaving a popular
lounge in Houston, Texas. The accident occurred early Monday morning
around 2 a.m., February 6 when the driver of a Lamborghini was leaving
the club in Uptown Park. The driver lost control of the vehicle and
struck two vehicles and and two pedestrians. Both pedestrians were
injured and one passenger in a struck vehicle were taken to a local
hospital with non-life threatening injuries.

Commentary It would
appear from the multiple reports of the accident that those injured are
going to be alright. One report cites the driver admitting to not being
completely familiar with the new vehicle, which I find inexcusable. The
danger that is associated with not properly operating a sports car
means it should be left at home (or on the track) until it can be safely
driven. You see, like it or not, drivers owe other motorists and
especially pedestrians a duty on the roadway. That duty is the safe
operation of a motor vehicle. Admitting to not being able to handle the
sports car is probably an admission of breaching that duty owed,
possibly making the driver liable. Duty and breach form the basis of
personal injury law, and if a victim were to seek compensation from the
accident, they would need to concretely show that a duty was owed and
then not granted. If both elements are found, a personal injury claim
must then specify damages and should be filed against a defendant who is
solvent.
