Commentary This is
an incredibly unfortunate and indeed unnecessary incident. I'm not here
to discuss the criminal side of the law, only to say that I hope they
catch the assailants quickly. Now, regarding the civil side of the law,
the only possible remedy involved is actually one that was litigated a
few years ago because of a similar instance in Fort Worth. In that
particular instance, Domino's was sued because safety procedures were
allegedly not met prior to a deliveryman arriving at a vacant house and
again being ambushed. These types of safety regulations are only
uncovered following the discovery phase of an independent investigation.
Issues like delivering to an area that had never before asked for a
delivery and ordering through a prepaid cellphone were contrary to the
chain's safety procedures at the time, allegedly making the
deliveryman's job more dangerous. Obviously these are separate instances
that may or may not share commonalities, but the point is safety
measures put in place by a company are meant to be followed. When they
are not, greater danger and perhaps liability are
produced.

As a Texas attorney practicing for 20 years, I have litigated all manner of personal injury cases. I use this blog as a place to write opinion / editorial articles on a variety of topics that catch my interest and as a means of sharing news stories relevant to personal injury accidents. I think the overwhelming majority of people are unaware just how common these types of accidents are and I hope this blog raises awareness to rather serious public safety concerns. However, this blog is simply a means for me to share my opinions and I would recommend that anyone who is considering seeking legal counsel should contact their family attorney.
