Pedestrian Tyrone Tyson Caldwell Injured in Hit and Run Accident in Waco, Texas
According to KXXV, a man was injured by a hit-and-run driver at a local
park in Waco, Texas. 41-year-old Tyrone Tyson Caldwell was walking in
Cameron Park facing oncoming traffic when a vehicle traveling the same
way swerved across the roadway and struck Caldwell from behind, Monday
January 23. The vehicle that struck Caldwell is believed to be an
extended cab red Ford Ranger pickup truck.

Commentary I hope
the victim experiences a fully recovery from this accident. Pedestrian
accidents can be a bit difficult to unravel, as liability is often
shared by multiple parties. For instance, a jaywalker may incur some
fault in a pedestrian accident, as the through traffic has right of way.
In this accident, however, it would appear the victim was doing all he
could to safely enjoy the park. In regards to a potential
civil claim, for a personal injury motion to have standing a plaintiff
must be able to prove the defendant owed them a standard of care.
Relevant to this accident, that care is typically manifested in safe
operation around pedestrians. This is especially poignant in a local
park where walkers, runners, and bicyclists are around. After a standard
of care is established, a victim must show that this care was breached
by the defendants actions. Lastly, relevant to the plaintiff, a damages
calculation must be met, essentially stating the total economic loss
incurred from the accident. It should be noted also that a claim only
has standing if the defendant is solvent.
