Pedestrian Larry King Injured in Hit-and-Run Accident in Tyler, Texas
According to KLTV, a man was injured in a hit-and-run pedestrian
accident in Tyler, Texas. The accident occurred around 6:15 p.m.
Saturday, January 21 when the pedestrian Larry King, was struck trying
to cross Gentry Parkway from N. Bois D'Arc. The vehicle that struck King
continued traveling eastbound on Gentry Parkway. Witnesses believe the
vehicle may have been a Chevy Cavalier or similar body style and have
identified a suspect, but not made an arrest. King is still in critical
condition.

Commentary First
and foremost, I hope the victim experiences a full recovery. Hit-and-run
accidents are particularly frustrating in personal injury law for a
number of reasons. First, closure cannot be obtained by the victim or
their family. Secondly, if civil options were available from the
accident, evidence is being destroyed by having the driver and vehicle
floating in the ether, so to speak. So, when the police arrest the
driver (and make no mistake they will), an independent investigation
should inspect both the accident scene and the vehicle in question
quickly. To have standing in a personal injury claim, a
plaintiff must be able to provide a court evidence that a certain care
they were owed was breached. This part of the claim is very dependent
upon the findings of the investigation, as the facts of the accident
will determine liability. In addition to a breach of care, a plaintiff
must be able to accurately portray the value of their injuries. This is
actually not as cut-and-dry as it may sound, as issues like
rehabilitation, lost wages, or employment deficiency are not easy to
assess.
