Dallas Torres Critically Injured in Bicycle Accident on Jefferson Boulevard Bridge in Dallas, Texas
According to the DMN, a man was critically injured in a bicycle accident
in Dallas, Texas. The incident occurred around 2 p.m. Saturday, January
14 when 32-year-old Dallas Torres was struck from behind by a braking
Honda on the Jefferson Boulevard bridge in Dallas, Texas. Torres was
taken to Baylor University Medical Center with three fractured vertebrae
and injuries to his head.

Commentary Against
my better judgement, I've read some of the comments in a few of the news
articles which discuss this bicycle injury. From just a logical
standpoint, is there a line between riding a bicycle on a neighborhood
street or a busy road heading into downtown? Sure. As I've mentioned in
the past, regardless of a personal view towards bicyclists on the
roadway, legally they are to be treated like any other motor vehicle.
This means operating safely, and in my opinion defensively,
when sharing the roadway. If a driver failed to do so, a personal injury
claim could be applicable, provided a few criterion are met. First, a
plaintiff must be able to show that a liable party owed them a standard
of care or duty at the time of the accident. In regards to motor vehicle
accidents, this is typically safe operation on the roadway. After a
standard is established, a victim must then prove that this care was
breached by the defendant's actions. This aspect of personal injury
litigation is typically aided by using a third party investigation so
that liability is concreted. From there, a damages determination must be
made, which accurately reflects the value of injuries incurred. This is
actually a very underrated portion of a personal injury claim, as
rehabilitation, deficiency, or missed work tangibly add to a damages
calculation.
